Roommates, an Oklahoma man plead guilty to cocaine possession, only to withdraw his plea and have his case dismissed after the substance turned out to be powdered milk.

According to The Oklahoman, Cody Gregg was arrested and sentenced to 15 years in prison last week, after he plead guilty to possession of cocaine with intent to distribute. Court records say the guilty plea was the result of an August arrest and charge of trafficking illegal drugs.

After a lab report showed a negative test for drugs, Cody withdrew his plea. An Oklahoma County judge approved the request, and Cody’s case was dismissed the next day.

Cody told the judge the powdered milk was from a food pantry. According to reports, Cody was riding his bike when an officer tried to stop him because he had no rear lights. He attempted to get away from the officer, pedaling after. Then, he jumped off his bike and fled, and officers found the white powder in his backpack.

“Inside the baggie was a large amount of white powder substance that I believed to be cocaine based on my training experience,” the officer said. “The white powder inside the baggy later tested positive for cocaine and was a total package weight of 45.91 grams of cocaine.”

Despite the initial testing, it turned out the baggy was full of nothing but powdered milk. If convicted, Gregg’s sentence could exceed 15 years, as he plead guilty in a past drug case and is currently on probation.

Cody was released Friday, after being in jail since his arrest in August.
